Estados Unidos prepara histórico caso criminal contra Raúl Castro

Un fiscal de Miami cercano a Trump lidera uno de los movimientos más agresivos de Washington contra Cuba en décadas

La relación entre Estados Unidos y Cuba podría estar entrando en uno de sus momentos legales y políticos más tensos en décadas. Fiscales federales en Miami estarían preparando un histórico caso criminal contra el expresidente cubano Raúl Castro, acusándolo de responsabilidad en el derribo de dos avionetas civiles de la organización Hermanos al Rescate en 1996. El incidente dejó cuatro muertos y se convirtió en una de las confrontaciones más explosivas entre Washington y La Habana tras la Guerra Fría. (El País)

En el centro del caso se encuentra Jason Reding Quiñones, fiscal federal del Distrito Sur de Florida y uno de los primeros fiscales nombrados durante el segundo mandato presidencial de Donald Trump. El fiscal con sede en Miami, hijo de exiliados cubanos y estrechamente vinculado a círculos políticos conservadores cubanoamericanos en Florida, se ha convertido rápidamente en una figura clave de la renovada línea dura de la administración Trump hacia los gobiernos de izquierda en América Latina. Según diversos reportes, el caso se centra en la destrucción ocurrida el 24 de febrero de 1996 de dos pequeñas aeronaves operadas por Hermanos al Rescate, una organización humanitaria y anticastrista con sede en Miami que realizaba misiones de rescate de balseros cubanos en el estrecho de Florida. Aviones MiG cubanos derribaron las aeronaves, causando la muerte de los cuatro hombres a bordo. Investigaciones internacionales concluyeron posteriormente que las avionetas fueron destruidas sobre aguas internacionales, aunque el gobierno cubano sostuvo que su espacio aéreo había sido violado. En ese momento, Raúl Castro se desempeñaba como ministro de Defensa de Cuba y era considerado el principal arquitecto del aparato militar de la isla. Informes difundidos por medios estadounidenses afirman que los fiscales podrían argumentar que Castro autorizó directamente o facilitó la operación que terminó en el ataque. (El País)

La posible acusación representaría una escalada extraordinaria en las tensiones entre Estados Unidos y Cuba. Aunque anteriormente varios oficiales militares cubanos fueron acusados por el incidente, Washington había evitado históricamente procesar directamente a Raúl Castro debido a las enormes implicaciones diplomáticas que podría tener una medida de este tipo. Analistas consideran ahora que el clima político bajo el segundo mandato de Trump ha cambiado radicalmente esos cálculos.

El momento elegido para el caso también posee un fuerte simbolismo político. Reportes indican que las autoridades federales planeaban anuncios legales alrededor del 20 de mayo, una fecha cargada de significado histórico para Cuba y las comunidades del exilio cubano en Miami. Críticos dentro de Cuba y medios afines al gobierno han acusado a Washington de utilizar el sistema judicial con fines políticos, mientras partidarios de la investigación describen el movimiento como una justicia largamente esperada para las familias de las víctimas. La estrategia legal emergente también refleja cambios geopolíticos más amplios en la región. Desde su regreso al poder, el presidente Donald Trump ha intensificado la presión sobre varios gobiernos de izquierda en América Latina, incluyendo Cuba y Venezuela. La administración ha combinado sanciones, aislamiento diplomático, investigaciones criminales y restricciones económicas como parte de una estrategia regional orientada a debilitar gobiernos autoritarios considerados contrarios a los intereses estadounidenses.

En semanas recientes, el secretario de Estado Marco Rubio pidió públicamente importantes reformas políticas y económicas en Cuba, incluyendo elecciones libres y la reducción del control militar sobre la economía de la isla. Mientras tanto, las investigaciones federales relacionadas con funcionarios cubanos parecen alinearse cada vez más con los objetivos de política exterior de la administración Trump. (El País)

Para muchos cubanoamericanos en el sur de Florida, el posible proceso judicial tiene un enorme peso emocional e histórico. El incidente de Hermanos al Rescate sigue siendo profundamente traumático dentro de las comunidades del exilio, donde las víctimas son vistas como símbolos de resistencia frente al gobierno cubano. Las familias de los fallecidos han pasado décadas exigiendo responsabilidades criminales por el ataque.

Dentro de Cuba, sin embargo, cualquier acusación formal contra Raúl Castro probablemente sería vista como un ataque directo al legado revolucionario establecido por Fidel Castro y el Partido Comunista Cubano. Aunque Raúl Castro se retiró oficialmente de posiciones de liderazgo hace años, muchos analistas consideran que todavía mantiene influencia dentro de las estructuras políticas y militares del país.

Expertos legales advierten que, incluso si se presentan cargos formales, las consecuencias prácticas siguen siendo inciertas.
